Professional Tax (PT): Maharashtra

Maharashtra levies Professional Tax under the Maharashtra State Tax on Professions, Trades, Callings and Employments Act, 1975.

Penalties for Non-Compliance in Maharashtra

Non-compliance carries serious financial and legal consequences:

PF default

Interest at 12% p.a. on unpaid contributions + damages of 5%, 25% of arrears. Under Section 14 of EPF Act, prosecution with imprisonment up to 3 years for wilful defaults.

ESIC default

The 2025 Labour Codes in Mumbai & Maharashtra

India’s four Labour Codes have been in force nationwide since 21 November 2025, replacing 29 legacy laws. Maharashtra has notified its draft rules under all four codes, the Code on Wages and the Industrial Relations Code (gazetted 28 April 2026) and the OSH Code (6 May 2026), now in the stakeholder-feedback stage ahead of final notification.

What the Maharashtra drafts signal for Mumbai employers: wage deductions capped at 50% of each pay period, dearness allowance revised twice a year, and the new uniform definition of “wages” that pushes basic pay, and therefore PF, gratuity and bonus, higher.

Yes. Every employer in Maharashtra must deduct and remit PT for employees earning above ₹10,000 per month. There is also an employer’s own PT liability of ₹2,500 per year regardless of employee headcount.

2. What is the threshold for ESIC registration in Mumbai?
