The Contract Labour (Regulation and Abolition) Act, 1970 — CLRA — governed contract staffing in India for over five decades. Since 21 November 2025 it stands subsumed into the Occupational Safety, Health and Working Conditions (OSH) Code, 2020, one of the four Labour Codes now in force. The regulatory architecture is familiar but meaningfully updated, and central and state rules are still being notified through 2026, so current requirements are tracked and verified by the TMS compliance team.
Licensing and registration under the OSH Code
- Contractor licence — staffing contractors supplying workers above the notified worker-count threshold must hold a valid licence. The Code raises that applicability threshold relative to the old CLRA and introduces the option of a single pan-India licence, simplifying multi-state deployment.
- Establishment registration — establishments engaging contract labour need registration under the Code, with establishments already registered under another law given relief from duplicate registration in specified cases.
- Core vs non-core activities — the Code generally restricts contract labour in an establishment's core activities, subject to defined exceptions such as sudden increases in volume. Classifying roles correctly is now a design decision, not an afterthought.
Principal-employer duties in the 2026 regime
Engaging a staffing partner does not transfer accountability wholesale. The principal employer must:
- Engage only licensed contractors and keep licence evidence on file;
- Ensure welfare facilities for contract workers at the workplace;
- Verify that wages are paid on time and in full — if the contractor defaults, liability travels up to the principal employer;
- Confirm PF and ESI contributions are deposited for eligible contract workers;
- Maintain the registers and returns prescribed under the Code and state rules.
