Contract staffing in India is regulated under multiple central and state laws. Non-compliance is not just a financial risk — it is a criminal liability for the principal employer (your company). Here’s what TMS manages on your behalf:

The Contract Labour (Regulation and Abolition) Act, 1970

If you engage contract labour through a contractor (TMS), you are the “Principal Employer” and TMS is the “Contractor.” TMS maintains all required registrations, licenses, and returns under CLRA. You are insulated from direct liability.

Employees’ Provident Fund (EPF)

All contract employees earning ≤ ₹15,000/month basic must be enrolled in EPF. TMS registers each employee, makes monthly EPF contributions (12% + 12%), and files ECR returns on time. UAN (Universal Account Number) is generated and employee’s PF account is maintained.

Employees’ State Insurance (ESIC)

Employees earning gross ≤ ₹21,000/month are covered under ESIC. TMS handles registration, monthly ESIC challan, and half-yearly returns. Employees get access to ESIC medical benefits — which often reduces attrition.

Professional Tax (PT)

Applicable in Maharashtra, Karnataka, Tamil Nadu, Andhra Pradesh, West Bengal, Telangana, and other states. TMS calculates state-specific PT, deducts from salary, and files returns to the concerned state authorities.

Minimum Wages Compliance

TMS ensures all contract employees are paid at or above the applicable Minimum Wages — which vary by state, skill category, and industry. Central and state minimum wage revisions are tracked and applied automatically.

TDS on Salaries (Section 192)

TMS computes TDS on salaries, deposits monthly, files Form 24Q quarterly, and issues Form 16 to employees annually.

CLRA Registers and Records

TMS maintains all mandatory registers under the Contract Labour Act: Form XII (register of contractors), Form XIII (employment card), Form XIV (service certificate), Form XV (wage register), Form XVI (muster roll). All registers are maintained digitally and available for client audit at any time.

A: TMS, as the legal employer, takes primary responsibility for labour law compliance, wages, and statutory obligations. All employment contracts are between TMS and the employee. However, if a dispute arises from workplace conditions at your premises, joint coordination is required. TMS provides guidance and legal support throughout.
