Hiring across Europe — what foreign employers should know

Europe combines a highly skilled, multilingual workforce with some of the most employee-protective labour law in the world. While the European Union provides common ground on matters such as working time, data protection, and transparent working conditions, employment contracts, dismissal procedures, social security, and collective bargaining remain governed at national level. Many European countries feature works councils, sector-wide collective agreements, and strict limits on at-will termination. For companies expanding across several European markets, incorporating an entity in each country is slow and expensive. An Employer of Record allows compliant hiring without that overhead. TMS supports companies expanding into Europe by coordinating compliant EOR engagements through an established EOR partner network, while applying the HR governance and process discipline developed over 20+ years of operations.

Key hiring considerations by country

SpainWorkers’ Statute with statutory severance on dismissal and 14 salary payments per year in many sectors15 days for objective dismissal
PolandLabour Code with notice periods and entitlements tied to contract type and tenure2 weeks to 3 months, depending on service
United KingdomStatutory minimum notice, auto-enrolment pensions, and unfair-dismissal rights after qualifying serviceStatutory minimum of 1 week per year of service, up to 12 weeks

How EOR simplifies your Europe expansion

  • Hire in multiple European countries without incorporating a separate entity and registering for payroll in each one.
  • Issue contracts that comply with national law, applicable collective agreements, and EU transparent-working-conditions requirements.
  • Administer national social security, pension, and tax withholding correctly for each jurisdiction.
  • Navigate strict dismissal rules — including notice, severance, and any works-council consultation — with local guidance.
  • Consolidate multi-country European payroll and reporting under a single TMS-coordinated engagement.

What Indian employers get wrong about hiring in Europe

Europe is not one employment market. It is a set of national labour regimes that happen to share a currency in places and a customs union in others. An offer that works in Poland can be unlawful in France. That is the whole reason an entity-per-country approach stalls.

Termination is the expensive difference

Indian employers plan around notice periods. Much of Europe does not work that way. Several jurisdictions require a substantive reason for dismissal, statutory severance calculated on tenure, and in some cases consultation before the decision is final. Budget for exit cost at offer stage rather than discovering it at the end.

Working time is regulated, not negotiated

Maximum weekly hours, minimum daily rest and paid annual leave are set by law across the EU and are generally more generous than Indian norms. A role designed around Indian leave entitlement will be non-compliant in most member states, and employees know their entitlements.

Data protection is not optional

Employee data moving from an EU employer back to an Indian parent is a restricted transfer under GDPR. It needs a lawful transfer mechanism and a documented assessment. This is the item Indian companies most often skip, and it is the one with the largest penalty exposure.

How TMS runs it

You sign one master agreement with TMS. Local employment happens through our partner EOR in each country, on a local contract under that country's labour law, with salaries paid in local currency. You invoice in INR or your preferred currency and deal with one HR contact rather than twenty-seven.

India to Europe EOR questions

Do we need an entity in each European country?

No. Employment sits with the local EOR in each country under that country's labour law, while your agreement is with TMS.

Why is severance such a large planning item in Europe?

Several jurisdictions require a substantive reason for dismissal and statutory severance based on tenure. Unlike India, you cannot generally rely on notice alone, so exit cost belongs in the original budget.

Does GDPR apply to us as an Indian parent company?

If employee data moves from an EU employer to India, it is a restricted transfer and needs a lawful mechanism plus a documented assessment. Take advice before the first payroll run.

Can we pay in Indian rupees?

You can be invoiced in INR or another agreed currency. Employees are paid in local currency, which is a legal requirement in most markets.

How fast can someone start in Europe?

Most European markets onboard within about two weeks of a signed offer. Country registration requirements, not TMS, set the floor on that.
